What Is a Guardian?
A guardian is a person who is appointed by the court to make decisions on behalf of another person. The person who is being cared for is known as the “ward.”
There are two main types of guardians:
- Guardian of the person: This type of guardian is responsible for making decisions about the ward’s personal care, including their medical care, living arrangements, and more.
- Guardian of the property: This type of guardian is responsible for managing the ward’s financial affairs, including paying their bills, managing their assets, and more.
In some cases, the court may appoint the same person to serve as both the guardian of the person and the guardian of the property. In other cases, the court may appoint different people to serve in these roles.
How to Establish Guardianship
Guardianship is established through the court system. The process begins when a person files a petition with the court to be appointed as a guardian. The court will then hold a hearing to determine whether the person is qualified to serve as a guardian and whether the person in need of a guardian is, in fact, incapacitated.
During the hearing, the court will consider several factors, including:
- The person’s age
- The person’s mental and physical health
- The person’s ability to make decisions
- The person’s ability to care for themselves
The court will also consider whether the person has executed a power of attorney or health care proxy and, if so, whether the person named in the document is willing and able to serve in that role.
Once a guardian is appointed, the court will continue to supervise the guardian’s actions to ensure that the ward is being properly cared for. The guardian will be required to file regular reports with the court.
